Based on the second article, Airbnb would be dead in France as you can't sublease for less than nine months per French law.
Leases in the US customarily provide for no assignment or subletting, so this may also violate those leases as well as any local ordinances prohibiting nite by nite rentals.

I fail to understand from that article why that is good news for Airbnb, it even says in NY, Airbnb has turned over the records to the state's attorney or something who can prosecute. Nothing in that article says Airbnb has gotten any legal victories that people can illegally sublet apartments in cities now, that I can see. Did I miss something?
I haven't rented in a long time, but in all the apartments I ever rented in the US, every single lease said you were not allowed to sublet without the owner's permission.
